1. Acceptance of Terms

By accessing and using listallexperts.com ('the Service'), operated by Schenker Labs GmbH, Zurich, Switzerland, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

These Terms of Service constitute a legally binding agreement between you (the 'User') and Schenker Labs GmbH (the 'Company', 'we', 'us', or 'our').

2. Description of Service

listallexperts.com provides a directory platform for finding consultants and freelancers in engineering, project management, and technology management. The Service offers:

• Free Public Access: Browse consultant listings without registration
• Search & Filtering: Filter and sort consultants by various criteria
• Data Export: Export consultant data to CSV/spreadsheet format
• Expert Profiles: Paid subscription plans for consultants to create and manage their profiles

3. Use of Service

3.1 Permitted Use

You may use the Service for lawful purposes only, including:

• Searching for professional consultants and freelancers
• Exporting data for personal or business use
• Contacting consultants through provided contact information

3.2 Prohibited Use

You may not:

• Use automated systems (bots, scrapers) to access the Service excessively
• Resell or redistribute the data for commercial purposes without authorization
• Use the Service to spam or harass consultants
• Attempt to gain unauthorized access to any part of the Service
• Interfere with the proper functioning of the Service
• Violate any applicable laws or regulations

4. Accuracy of Information

While we strive to maintain accurate and up-to-date information, listallexperts.com does not guarantee the accuracy, completeness, or reliability of any consultant information displayed on the Service. Users should verify information independently before making business decisions.

5. No Warranties

The Service is provided 'as is' and 'as available' without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Limitation of Liability

listallexperts.com and Schenker Labs GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to use the Service (if any).

7. Data Export

The export feature allows you to download consultant data in CSV/spreadsheet format. By using this feature, you agree to:

• Use the exported data in compliance with GDPR and other applicable data protection laws
• Not share or sell the data to third parties without proper authorization
• Respect the privacy rights of the consultants listed
• Use the data only for legitimate business purposes

8. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, and software, is the property of Schenker Labs GmbH / listallexperts.com and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute any content without our prior written permission.

9. Third-Party Links

The Service may contain links to third-party websites (consultant websites, LinkedIn profiles, etc.). We are not responsible for the content, privacy policies, or practices of third-party websites. Access to third-party sites is at your own risk.

10. Modifications to Service

We reserve the right to modify or discontinue the Service (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

12. Subscription Plans for Consultants

12.1 Subscription Tiers

Consultants and freelancers can create profiles on the platform by subscribing to one of the following plans:

• Basic Plan: CHF 2.00 per month (allows up to 3 skills, no external links, no logo)
• Standard Plan: CHF 4.00 per month (allows up to 12 skills, up to 3 external links, includes logo)
• Advanced Plan: CHF 1,000.00 per month (allows up to 48 skills, up to 15 external links, includes logo)

All prices are in Swiss Francs (CHF) and exclude any applicable taxes, which will be added at checkout where required by law.

12.2 Payment Terms

Subscriptions are billed monthly in advance via Stripe, our secure payment processor. By subscribing, you authorize Schenker Labs GmbH and Stripe to charge your selected payment method on a recurring monthly basis until you cancel.

All payments are processed in accordance with Swiss law and EU payment regulations. You are responsible for providing accurate and current payment information.

12.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price for your selected plan.

12.4 Subscription Changes

You may upgrade or downgrade your subscription plan at any time through your profile settings. Changes take effect immediately, and billing adjustments are prorated according to Stripe's proration policies:

• Upgrades: You will be charged the prorated difference for the remainder of the current billing period
• Downgrades: You will receive a prorated credit applied to your next invoice

If you downgrade to a plan with fewer features (e.g., fewer skills or external links), you must adjust your profile to comply with the new plan's limits before the change can be saved.

12.5 Cancellation Policy

You may cancel your subscription at any time through your account settings or via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You will retain access to your subscription features until the end of the paid period.

No Refunds: Subscription fees are non-refundable. If you cancel, you will not receive a refund for the current billing period, but your subscription will remain active until the period expires.

Exception: In accordance with Swiss and EU consumer protection laws, consumers (private individuals, not businesses) have the right to withdraw from distance contracts within 14 days of purchase. To exercise this right, contact us at privacy@listallexperts.com within 14 days of your initial purchase.

12.6 Payment Failures

If a payment fails, your subscription will be marked as inactive, and your profile will be unpublished from the public directory. We will attempt to retry the payment according to Stripe's retry schedule. If payment cannot be processed after multiple attempts, your subscription will be cancelled.

12.7 Free Trial & Promotional Offers

We may offer free trials or promotional pricing from time to time. Terms for such offers will be clearly communicated at the time of signup. Unless otherwise stated, your subscription will convert to a paid subscription at the end of the trial period.

12.8 Profile Publishing

Your consultant profile will only be visible in the public directory while your subscription is active and your profile is complete (including all required fields). If your subscription expires or payment fails, your profile will be automatically unpublished.

12.9 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated to existing subscribers at least 30 days in advance and will take effect at the next renewal date. By continuing your subscription after the price change date, you accept the new pricing.

13. Consumer Rights (Swiss & EU Law)

13.1 Right of Withdrawal (Widerrufsrecht)

In accordance with Swiss and EU consumer protection laws, consumers (private individuals) have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire 14 days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us (Schenker Labs GmbH, privacy@listallexperts.com) of your decision to withdraw by an unequivocal statement (e.g., email).

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day we are informed about your decision to withdraw. We will use the same payment method you used for the original transaction unless expressly agreed otherwise.

Note: If you have already activated your profile and used the service during the withdrawal period, you may be charged for the value of services provided up to that point.

13.2 Statutory Warranty Rights

Under Swiss and EU law, consumers are entitled to statutory warranty rights for defective services. These rights are not affected by these Terms of Service.

14. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the substantive laws of Switzerland, excluding the Swiss conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Jurisdiction for Businesses: For disputes arising from or in connection with these Terms involving business users (merchants, companies, or professionals), the exclusive place of jurisdiction shall be Zurich, Switzerland (Gerichtsstand Zürich, Schweiz).

Jurisdiction for Consumers: If you are a consumer (a natural person acting for purposes outside your trade, business, or profession), mandatory consumer protection laws in your country of residence may apply, and you may have the right to bring legal proceedings in your country of residence.

EU Consumers: Nothing in these Terms affects your rights as a consumer under EU Directive 2011/83/EU (Consumer Rights Directive) or Regulation (EU) 524/2013 (Online Dispute Resolution).

15. Data Protection & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal data in compliance with Swiss Federal Data Protection Act (FADP) and EU General Data Protection Regulation (GDPR).

16. Limitation of Liability

16.1 For Business Users

To the maximum extent permitted by Swiss law, Schenker Labs GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from your use or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or CHF 100.00, whichever is greater.

16.2 For Consumers

Nothing in these Terms shall exclude or limit our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited under Swiss or EU consumer protection law

16.3 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or failure of third-party services.

17. Intellectual Property Rights

All intellectual property rights in the Service, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by or licensed to Schenker Labs GmbH and are protected by Swiss and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not:

• Copy, modify, or distribute any part of the Service without our prior written consent
• Reverse engineer, decompile, or disassemble any software used in the Service
• Remove or alter any copyright, trademark, or other proprietary notices
• Use our intellectual property for commercial purposes without authorization

18. Account Termination

18.1 Termination by User

You may terminate your account at any time by canceling your subscription through your account settings. Upon termination, your profile will be unpublished, and you will lose access to subscription features at the end of your current billing period.

18.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you:

• Breach these Terms of Service
• Provide false, inaccurate, or misleading information
• Engage in fraudulent or illegal activities
• Violate the rights of other users or third parties
• Use the Service in a manner that harms or could harm the Service or other users

In case of termination for cause, you will not be entitled to a refund of any prepaid subscription fees.

19. Indemnification

You agree to indemnify, defend, and hold harmless Schenker Labs GmbH, its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content or information you provide through the Service

20. Severability & Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Schenker Labs GmbH regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.

21. Language & Translation

These Terms of Service are provided in English. In case of any discrepancy between the English version and any translation, the English version shall prevail to the extent permitted by applicable law.

ListAllExperts is a global expert directory. It is important to understand the nature of our service:

• Directory Service Only: ListAllExperts provides a platform for experts and consultants to list their profiles. We do not employ, endorse, or represent any listed expert.
• No Skill Verification: We do not verify, test, certify, or evaluate the skills, qualifications, expertise, credentials, or claims made by any listed expert. Expertise is self-declared by each expert.
• Identity Anchoring: All listed experts are identity-anchored through a verified payment method. This helps reduce spam and fake profiles, but it does not constitute verification of professional qualifications.
• Client Due Diligence Required: Clients are solely responsible for conducting their own due diligence before engaging any expert. This includes verifying credentials, requesting references, reviewing portfolios, and assessing suitability for their specific needs.
• No Ratings or Reviews: We intentionally do not provide a rating or review system. Expertise is demonstrated through profiles, portfolios, references, and professional signals - not platform ratings.
